MELAKA, Oct 12 — Four male students suspected of being involved in the alleged gang rape of a Form Three student at a secondary school here will still be allowed to sit for their Sijil Pelajaran Malaysia (SPM) examination, Education Minister Fadhlina Sidek confirmed.

The case gained public attention after it was reported that a 15-year-old female student was allegedly gang-raped by two senior students in a classroom last week.


The incident was reportedly recorded and witnessed by two other students on their mobile phones. All four suspects have since been remanded to assist with the police investigation.

Speaking after a special meeting today, Fadhlina said that although the case is under police investigation, the students’ right to education will be upheld, Sinar Harian reported.

“SPM will proceed as planned. We will ensure they do not fall behind in their education even though the investigation is ongoing,” she was quoted as saying.


Oral tests for the examinations will begin next month, along with practical assessments for laboratory-based subjects.

The meeting, held at the Melaka State Education Department, included State Executive Councillor Datuk Rahmad Mariman, Melaka Police Chief Datuk Zulkairi Mukhtar, and Director-General of Education Dr Mohd Azam Ahmad.

Fadhlina said the ministry’s main focus now is on providing full emotional and psychosocial support to everyone at the school, including the victim, other SPM candidates, and teachers, to ensure their preparations are not disrupted.

“Counsellors will be deployed to the school,” she said, noting that the school is considered one of the best in Melaka.

She confirmed that the victim is still hospitalised and is receiving further treatment and psychological counselling.

Fadhlina stressed that the ministry would leave all legal action to the police while it focuses on disciplinary support, emotional wellbeing, and safety at the school level.

She also reminded the public to respect the laws that protect the identities of minors involved in such cases.

“Parents also need to pay attention and take cases like this seriously,” she added.

PETALING JAYA: The Malaysian Communications and Multimedia Commission (MCMC) has warned the public against sharing a video said to be linked to the alleged gang rape of a Form 3 student in Melaka recently.
In a statement, the commission said sharing such content online could be an offence under Section 233 of the Communications and Multimedia Act 1998, which deals with improper use of network facilities.

The offence is punishable by a fine not exceeding RM500,000, imprisonment of up to two years, or both, upon conviction.


The MCMC added that it was working with the police and service providers to remove any content that could affect the investigation into the case or cause emotional harm to the victim.

It also reminded media outlets to report the case responsibly and avoid publishing sensational material that could reveal the victim’s identity.


Doing so would violate Section 15 of the Child Act 2001, which bans the publication of any detail that may identify a child victim.

Four Form 5 students are under remand until Oct 16 over the gang rape of the female student in a classroom at their school in Alor Gajah, Melaka.

Two of the suspects reportedly committed the offence on the 15-year-old victim at about 2.50pm on Oct 2, while the other two watched and recorded the incident with their handphones.

PETALING JAYA: Four Form 5 students in Alor Gajah, Melaka, have been arrested over the gang rape of a Form 3 girl in a classroom at their school.
Melaka police chief Dzulkhairi Mukhtar said the four suspects have been remanded until Oct 16 to assist in the investigation, MalaysiaGazette reported.

The investigation is being held under Section 375B of the Penal Code for gang rape, punishable by 10 to 30 years in prison upon conviction.

The suspects reportedly committed the offence on the 15-year-old victim at about 2.50pm on Oct 2, while she was headed to her classroom to collect something she had left behind.

Two of the suspects reportedly watched and recorded the incident with their handphones.


The education ministry said it viewed the case seriously and will fully cooperate with the police investigation.

“We will not compromise with sexual misconduct, and stern action must be taken on anyone found guilty of such offences,” it said in a statement.

It urged school administrators to follow its guidelines on managing cases of sexual misconduct to safeguard the wellbeing of students and teachers.

The education ministry has asked the Malaysian Communications and Multi­media Commission (MCMC) to block the spread of videos ­related to the recent gang rape case involving students at a ­secondary school in Melaka state.

Education Minister Fadhlina Sidek said the action was taken to ensure that videos of the alleged crime did not ­continue to be ­disseminated.

“We have asked the relevant ministry to take action to ensure that this issue does not continue to spread because it involves our students.


“So, we ask for the community’s understanding that these are minors who must be protected,” she said on Saturday when attending the handover ceremony for the construction project of the Bandar Baru Sungai Lalang National Secondary School in Ambangan Heights, Kedah state’s Sungai Petani.

Fadhlina explained that the ministry would not compromise and would continue with ongoing internal investigations into all aspects of the incident.

“We are conducting an ­investigation, and this is already within the jurisdiction of the authorities … This is a very serious case.

“God willing, tomorrow we will go down to Melaka to ensure this issue can be addressed immediately,” she said.

Fadhlina added that the ­students alleged to have been involved in perpetrating the offence have been arrested and that the victim was ­currently ­receiving psychosocial support and treatment at a ­hospital


“Meanwhile, from the aspect of school safety, the ministry has instructed the Melaka education department to take immediate action to ensure all support among students and safety is ­considered, including ensuring that all children and teachers are given immediate guidance regarding this case because it has already gone viral,” she said.

However, she added that ­classes at the school would ­continue as usual and focus would be given to safety aspects involving students and teachers, especially ahead of the coming examinations.

“We know that this school will also face exams and will still be operating as usual. So schools must focus fully on safety issues and provide full ­psychosocial guidance to all students and teachers regarding this case,” she said.

It is believed that the incident first came to light after a video recording of the act was circulated among the ­students at the school before being reported to the teachers on Friday.

News of the incident was ­subsequently reported to the victim’s­ ­mother that same day.

The victim’s mother then lodged a police report and all four ­suspects were detained for questioning.

The case is currently being investigated under Section 375B of the Penal Code, which carries a sentence of between 10 and 30 years’ ­imprisonment.

Melaka police chief Dzulkhairi Mukhtar ­confirmed that the police had received the report and said the case was still under investigation.

“All suspects have been remanded for six days until October 16 to assist with the investigation,” he said.
